This policy is prepared in compliance with the requirements of the Data Protection Act 1998, as replaced and superseded by the General Data Protection Regulation (EU) 2016/679, as in force from time to time (Data Protection Law). For the purposes of Data Protection Law, the data controller is uMake, Inc.
By downloading our Services you are accepting the terms described in this Policy. If you do not agree with this Policy, please delete the app and all Services from your device and stop using the Services. If you continue to use the Services you express that you accept this policy.
1. Information we collect
When you use the Services we collect information in three ways:
1. information you provide to us;
2. information we collect when you use our services (for example using “cookies” and other technologies);

Information you provide to us:
When you use our Services, we collect information that you choose to share with us. Here are some examples:
Use of our Website without an Account: You do not need to create an account just to browse our website or download the app. When you use the website, even without creating an account, we still collect from you some of the information described in the “Information we collect when you use the services” section
User account, social media log-in: To use our Services you need to set up a user account, so we need to collect some information about you such as: a username you would like to go by, a password and an email address. To make it easier for others to find you, you can choose to provide some additional information that will be publicly visible on our Services, such as profile pictures, a name, or other identifying information. If you use the option to log in with social media we will receive the information included in your public profile, such as your social media handle, you gender, age range, country, and language. Other services, such as commerce products, may also require you to provide us with a debit or credit card number and its associated account information
Information you share through the services: When you send information through the Services, such as when you share your designs with the community, comment on a blog or offer a testimonial, we receive this information. Please keep in mind that blogs and testimonials are located in the public areas of our services and everyone can see them. If you provide a testimonial, you name will be posted along with the testimonial. Also, when you share a design or other content, the users you send this to or that see it can always, download the content, copy it, and share it, within or outside the app. Please don’t send messages or share content that you would not want others to save or share. If you create content in your own account and do not post or share it, we will not access such content without your permission.
Communications with us, tech support: If you contact our technical support for assistance with the Services, or when you send us messages, or suggestions or communicate with us in any other way, we will collect the information you provide. If you take advantage of our live chat feature to receive technical support or ask general questions regarding use of our platform we retain copies of the live chats. If our live chat is offline we will collect your name and email address so that we may reply to your request through our support desk.
Payment information: To make payments to us, you will need to provide billing information, such as a name, address, email address and payment card information. The processing of the payment information is done by a third party (Apple). We do not have access to your payment card information or other information you provide to facilitate the payment. Information we collect when you use the services:When you use our Services, we collect information about which of the services you use and how you use them. We may know, for example, that you used a particular tool to create a design, viewed other users’ designs, and shared your design with the community. Below is a more detailed explanation of the types of information we collect when you use our Services:
Usage Information. We collect information about your activities through our Services. For example, we collect information about:- How you interact with the Services, such as when you log into our Services and when you return, which tools you use to create your designs, which pages you view, which searches you submit etc. We also use tools to track your actions with respect to emails we send you such as when you open them and what you click in them. To learn about cookies and other technologies we use to do this, please see “Cookies and other Technologies” below.- How you communicate with other users of the Services, such as their names, the time and date of your communications, the number of messages you exchange with your contacts, which contacts you exchange messages with the most, and your interactions with messages (such as when you open a message or save a design).
Content Information. We collect information about the content you provide, for example what is the design ID, date created, opened or published, etc.
Device Phonebook. Because uMoji gets its strength from sharing with friends and the community, we may—with your consent—collect information from your device’s phonebook.
Camera and Photos. Our Services allow you to record, take and upload pictures and videos of your creations. To allow you to upload or share media from your camera roll we need to access your camera or photos. To allow you to use uMoji we are using Apple's Face Data using Apple's iPhone X TrueDepth Camera. uMoji will be using the Face Data from the TureDepth Camera only in the uMoji screen to express your facial expression on the avatar you created. In non-iPhone X devices we're using the regular front-facing camera. NO FACE DATA IS BEING COLLECTED, SAVED OR BEING SHARED WITH ANY THIRD-PARTY BY US.
Location Information: We collect information about your estimated location which may be deduced by various technologies including IP address.
Log file information: We collect log information which your browser or device automatically reports each time you interact with the services. This information includes:- details about how you have used our Services.- device information, such as hardware setting, web browser type and language.IP address.- identifiers associated with cookies or other technologies that may uniquely identify your device or browser - times you have accessed pages- pages you have viewed- pages you visited before or after navigating to our website
Information we collect from third parties: We may collect information about you from other users of the Services. For example, if another user allows us to collect information from their device phone book —and you are one of that user’s contacts—we can combine the information we collect from that user with other information we have collected about you. We also obtain information from third parties including social media networks, advertising providers and analytics providers (see below) or publicly available sources. We combine that with the information we collect through our services.
2. How we use your information
We use the information we collect about you in order to provide you with a better, more exciting platform with features that interest and work well for you. Some of the ways that we do that include:

3. How we share your information
We may share information collected about you in the following ways:
With other platform users: We may share the following information with members of the community:
- information about you, such as your username, name, and profile picture.
- information about how you interact with Services, such as the names of your followers on the platform.
- any additional information you have agreed that we share. For example, when you let us access your device phonebook, we may share information about you with other users who have your phone number in their device phonebook.
With all platform members, our business partners, and the general public. We may share the following information with all members of the community as well as with our business partners and the general public:
- public information like your name, username, profile pictures.
- any content that you post publicly. If we think your design will be interesting to the community we may include it in our “featured” category.
With third parties. We may share your information with the following third parties:
With service providers, sellers, and partners.We share information about you with service providers to perform functions and process your data and to help provide our app and Services including hosting and storage providers, payment processors etc. In addition to using your information to help us with providing our Services, service providers may use your personally identifiable information internally to improve their own Services and may share it in connection with a sale, divestiture, or transfer of business assets or to protect their rights or to comply with the law. In addition, our providers may share your personally identifiable information with their own third-party service providers. They may also combine the information about you that we share with them with contact and social media information related to you that they collect from publicly available sources or from third parties.
We may share information about you if we reasonably believe that disclosing the information is needed to:
- comply with any valid legal process, governmental request, or applicable law, rule, or regulation.
- protect the rights, property, and safety of us, our users, or others.
- detect and resolve any fraud or security concerns.- Transfer Outside the EEA. If you are based in the European Union, when you signed up for the Services you agreed that we may transfer your Personal Information to the USA for the purposes listed in this clause 4. Rest assured that we will always ensure any transfer is subject to appropriate security measures to safeguard your Personal Information.
With third parties as part of an acquisition or liquidation. We are involved in a merger, asset sale, financing, corporate divestiture, reorganization, or acquisition of all or some portion of our business to another company or if we undergo liquidation or bankruptcy proceedings, we may share your information with that company before and or the transaction closes or the proceedings are completed.
We may also share with third parties—such as advertisers—aggregated, or de-identified information and we do not limit our third-party providers from using, selling, licensing, distributing, or disclosing de-identified data.
We may share information in other ways if you give us consent or direct us to do so.
4. How we store and protect your information
We take reasonable precautions to protect your information. Please keep in mind that the Internet is not a 100% secure medium for communication, and we cannot guarantee that the information collected about you will always remain private when using our services.
5. Your access and choice about your information
Access and Updates to your Information. You can access and update most of your account information in the app by entering to the User Profile setting screen. If you need to access, update, or delete other personal information that we may have, you can request it by changing it on the User Profile screen or send a request to ‘email@example.com’. To protect your privacy, before we give you access or let you update your information, we may we may ask you to verify your identity or provide additional information. We will try to update and allow you to access your information for free, but if it would require a disproportionate effort on our part, we may charge a fee. We will disclose the fee before we comply with your request. We may reject a request for a number of reasons, including, for example, that the request risks the privacy of other users, requires technical efforts that are disproportionate to the request, is repetitive, or is unlawful.
Revoking Permissions. If you change your mind about allowing us to collect information from certain sources that you have already consented to, such as your phonebook, you can revoke your consent by changing the settings on your device if your device offers those options. Please note that doing this may cause certain services to lose full functionality.
Closing your account: You may stop using the Services or uninstall the app at any time. When you uninstall the app, we will no longer collect information from you, unless you choose to provide it, for example, by sending us an email. If you ask to delete your account, we will promptly delete it. While we will promptly delete your designs and files, we will retain certain information about you for as long as necessary in order to provide any services you have requested. We will retain and use this information only as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and then delete it.
Even if you uninstall the app, keep in mind that third parties that received your information, like third parties we shared information with, friends that you sent content to or community members that viewed your posts, may not delete it. Also, and that the deleted information may remain in backup copies for a reasonable period of time (but will not be available to others).

Emails: You can stop receiving promotional email communications – such as our newsletter – from us by clicking on the “unsubscribe link” provided in such communications. Use of the Services is limited to individuals aged 13 years and up. We do not knowingly collect or solicit any information from anyone under the age of 13. 8. Browser do not track
Our website and app do not support Do Not Track (DNT) at this time. We transfer, process, and store information about you on servers located in the United States.
